These Terms govern

• the use of Scouting Africa, and,
• any other related Agreement or legal relationship with the Owner

in a legally binding way. Capitalized words are defined in the relevant dedicated section of this document.

The User must read this document carefully.

Although the entire contractual relationship relating to these Products is entered into solely by the Owner and Users, Users acknowledge and agree that, where Scouting Africa has been provided to them via the Apple App Store, Apple may enforce these Terms as a third-party beneficiary.

We actively partner with industry leaders to ensure participants gain access to exclusive opportunities and are equipped with the tools needed for professional development. Scouting Africa stands as a beacon of creative excellence, empowering Africa’s next generation of creators to thrive, lead, and inspire on global platforms.

Content Rights and Usage

By uploading content to Scouting Africa, Users explicitly grant Scouting Africa a worldwide, royalty-free, perpetual, irrevocable, and transferable right to use, modify, adapt, distribute, and publish such content across all media platforms and formats, including but not limited to:

• Marketing materials and campaigns
• Social media content
• Promotional materials
• Website content
• Educational materials
• Press releases and media communications
• Digital and print publications
• Advertising materials
• Contest promotions and showcases
• Portfolio presentations
• Talent showcases and exhibitions
• Industry networking events

This includes the right to edit, crop, enhance, or otherwise modify the content as Scouting Africa deems appropriate for such purposes.

What the User should know at a glance

Please note that some provisions in these Terms may only apply to certain categories of Users. In particular, certain provisions may only apply to Consumers or to those Users that do not qualify as Consumers. Such limitations are always explicitly mentioned within each affected clause. In the absence of any such mention, clauses apply to all Users.

Content Guidelines

Below you find all our content restrictions. You may not upload content that:

• Infringes any copyrights or other rights like: trademark, privacy rights, etc.
• Is sexually explicit or promotes a sexual service
• Is defamatory, racist or abusive
• Harassment to other users
• Contains hateful or discriminatory speech
• Promotes or supports terror or hate groups
• Provides instructions on how to assemble explosive/incendiary devices or homemade/improvised firearms
• Exploits or endangers minors
• Depicts or encourages self-harm or suicide
• Unlawful real-world acts of violence
• Vivid, realistic, or particularly graphic acts of violence and brutality
• Sexualized violence, including rape, torture, abuse, and humiliation
• Animal cruelty or extreme violence towards animals
• Promotes fraudulent money-making schemes, unlawful transactions, or the use of deceptive marketing practices
• Conveys false or misleading claims about health-related information
• Misrepresents professional credentials or industry affiliations
• Contains unauthorized use of trademarks or branded content
• Violates any applicable law

Terms of Use

Unless otherwise specified, the terms of use detailed in this section apply generally when using Scouting Africa.

Account Registration

To use the Service Users may register or create a User account, providing all required data or information in a complete and truthful manner. Users may also use the Service without registering or creating a User account, however, this may cause limited availability of certain features or functions.

Users are responsible for keeping their login credentials confidential and safe. For this reason, Users are also required to choose passwords that meet the highest standards of strength permitted by Scouting Africa.

Conditions for Account Registration

• Users must be at least 18 years old or have legal guardian consent
• Only one account per user is permitted
• Accounts must not be created using automated methods
• Users must provide accurate and truthful information
• Account sharing is not permitted unless explicitly authorized

Content Ownership and Rights

By uploading content to Scouting Africa, Users maintain their original copyright but grant Scouting Africa extensive rights to use the content as described in the Content Rights and Usage section. Users represent and warrant that they have all necessary rights to grant these permissions.

Platform Usage Rules

• Users must respect other users’ intellectual property rights
• Commercial solicitation is not allowed without explicit permission
• Users must not attempt to manipulate platform metrics or rankings
• Harassment or bullying of other users is strictly prohibited
• False or misleading representation of abilities or credentials is forbidden

Account Termination

Scouting Africa reserves the right to terminate or suspend accounts that violate these terms. Users may also terminate their own accounts by contacting support. Upon termination:

• Previously granted content rights remain in effect
• Users lose access to all platform features
• Pending transactions may be cancelled
• User data will be handled according to our privacy policy

Liability and Indemnification

Users agree to indemnify and hold harmless Scouting Africa from any claims arising from:

• Violation of these terms
• Unauthorized use of materials
• Violation of rights of third parties
• Violations of applicable laws

Modifications to Terms

Scouting Africa reserves the right to modify these terms at any time. Users will be notified of significant changes. Continued use of the platform constitutes acceptance of modified terms.

Governing Law

These terms are governed by applicable laws. Any disputes shall be subject to the exclusive jurisdiction of the courts where Scouting Africa is based.

Any person or entity using the Scouting Africa platform

Content

Any material uploaded to or created on the platform including but not limited to images, videos, text, audio, and combinations thereof

Platform

The Scouting Africa website, mobile applications, and related services

Creative Work

Any original artistic, musical, photographic, design, or other creative content produced by users

Contest

Any competition, challenge, or promotional event hosted on the platform
